Will of WILLIAM ABBOTT

Wake Co, NC 1777

In the name of God, Amen. I William Abott of the province of North Carolina and Wake County being sick and weak of body but of perfect mind and memory thanks be given to God for the same and calling to mind the mortality of my body and knowing that it is appointed once for all men to die - Do give and dispose of my worldly goods in manner and form following. First and forrmost I give and recommend my soul into the hand of God that gave it and my body to the ground to be buryed in a decent and Christian like form at the descretion of my executers. Imprimis I give and bequeath to my wellbeloved son Abraham all the land as I possess above the mouth of Abotts Creek with my manner plantation oly referring the life of my wife Agness in the manner plantation. Next I give to my son Jacob that part of land on the south side of the said creek from the mouth of Counces branch to the outside line. Next I give to my son Isac the residue of my land from the mouth of Counces branch to the river and as for household furniture I give and bequeath to my grandson James Abott one cow and calf and the first colt that is fallen from either of my mares and one featherbed the rest of my household stuf to my wife Agness. I likewise give to my son William five pound prock money to be raised out of my stock. Item I give to my son John eigthteen pound prock money. I likewise make constitut and ordain my espoused Agness and my wellbeloved son Jacob my hole and sole executers in witness whereof I have heronto I have set my hand and fixed my seal.

Proved in open court, Wake County June term 1777. Recorded in Book A pages 95 & 96 the 12th day of July 1777.


I'm unsure of the first witness's name. I've kept William's spelling, including the differences in Abott / Abbott. "Prock" money would be proclamation money.
I do not know of a connection between this William and my Benjamin Abbott, whose will follows, but land on Abbotts Creek puts them in the same territory, as Benjamin's wife's family was there. With 39 years between their deaths, Benjamin might be a grandson of William's - but I haven't found wills for the sons named here.


Will of BENJAMIN ABBOTT

Rowan County, August Term 1816, Book G p439

In the name of God Amen. This 7th day of April in the year of our Lord 1813, I Benjamin Abbott of Co of Rowan and State of NC being strong in body and of perfect mind and memory thanks be to God therefore bringing into mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament that is to say, prinsapally and first of all I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend to the Earth to be buried decent and Christian like manner at the discrestion of my executors nothing doubting but at the general resurrection I shall receive the same again by the almighty power of God - and as touching such worldly estate wherewith it hath pleased God to bless me with in this life I give demise and dispose of the same in the following manner and form - first of all my will is for so much of my personal property to be sold as will satisfy all my just debts - Secondly I give and bequeath to my dear beloveth wife Mary Abbott the plantation where on I now live and also my other tract on the road and all my ..groc. all my stock and personal property as long as she lives if in case she continues a widow her lifetime in case she marries for her only to have my plantation whereon I now live her life time and also my negroes and my personal property to be sold and the money ariveing therefrom to be equilly devided to my wife and six children, to wit Joseph William & Starling Lucy Sarah and Mary first paying out of my estate to my son Starlin and my two daughters Sarah and Mary Abbott the sum of $50 each to make them equal with my two sons Joseph & William and my daughter Lucy which I already gave them - Thirdly my will is that after the death of my loveing wife for my son Joseph and my son Starlin to have the plantation on the Yadkin that I now live on for them to devided the land equally and to be praised by two freeholders the value of the land and for them to pay to my three daughters Lucy Sarah and Mary an equal portion out of the valuation of the land so that they be all equil in case my two sons Joseph and Starlin do not agree in the division and valuation of the land then the land to be sold and the money to be equally divided to my two sons Joseph and Starlin and my three daughters Lucy Sarah and Mary - Fourthly my will also is for my son William Abbott after the death of my loveing wife to have my tract of land that he now lives on the main road the land to be valued by two freeholders and for him to pay an equal portion of the valuation to my three daughters Lucy Sarah and Mary so they be equal share alike and in case my son William is not satisfied in the valueation of the land then the land to be sold and the money to be divided as before mentioned. Fifthly I hereby constitute and appoint my loveing wife Mary Abbott my Sole Executor of this my last will and testament and I do hereby disalow revoke and disanull all and every other former testaments wills and legacies bequeaths executors by me in any way by me before this time named willed and bequeathed ratifying and confirming this and no other to be my last will and testament in witness whereof I have hereunto set my hand and seal the day and year before written -
